Item 8.01.
Other Events.
On June
2, 2010, Kohlberg Capital Corporation (the "Company") was
notified by The Nasdaq Stock Market ("Nasdaq") that the
Company had regained compliance with Nasdaq Listing Rule 5250(c)(1) by filing
with the Securities and Exchange Commission on May 28, 2010 its Quarterly Report
on Form 10-Q for the quarter ended September 30, 2009, its Annual Report on
Form 10-K for the year ended December 31, 2009 and its Quarterly Report on
Form 10-Q for the quarter ended March 31, 2010 and that the Company is in
compliance with all other applicable listing standards. As a result,
the hearing that the Company had previously requested with the Nasdaq Hearings
Panel has been cancelled, and the Company's common stock will continue to be
listed and trade on the Nasdaq Global Select Market.
